Effective December 9, 2020: Updated Operational Protocols for Town and Village Justice Courts

For the past several months, the Unified Court System has permitted in-person proceedings in Town and Village courts in accordance with the Governor’s un-pause New York plan.  Foot traffic in the courthouses has been gradually increased to correspond with an improvement in the metrics measuring the spread of the Coronavirus.  Recently, the metrics have indicated the need to reduce foot traffic once again in the courthouses to protect the health and safety of litigants, lawyers, court staff and judges. The Court immediately decreased in-person proceedings to protect the health and safety of all court users, court staff and judges and to further reduce the community spread of the Coronavirus. The new operational protocols are intended to create an environment where the “normal” is a virtual appearance and in-person appearances are rare.

Operational Changes Include:

  • Modified Courthouse Operations- All scheduling and calendar matters have been temporarily adjourned.
  • Reduction in Court Staff availability- It may be difficult to communicate with the court during this time and we apologize for any inconvenience.
  • Occupancy to the courtroom shall be prohibited and access shall be denied during this time. Entrances to the Courtroom will be locked.

Modification to Court Proceedings:

  • No new prospective trial jurors (criminal or civil) will be summoned for jury service until further notice. Pending criminal and civil trials will continue to conclusion virtually. Court proceedings including evidentiary proceedings will be proceeding only virtually. Trials in civil and criminal cases will be conducted virtually. Courts will retain some limited discretion for in-person proceedings. Criminal and vehicle and traffic matters will be proceeding virtually.

The New York State Unified Court System conducts virtual court appearances using Microsoft Teams which is a virtual meeting platform very similar to Skype.

When you have court, you will “wait” in this VIRTUAL courtroom lobby until the Judge, or Court Clerk invites you in for your case.

The Town Court is your local municipal court with juridiction over Traffic, Criminal, Civil, Small Claims, Landlord/Tenant, and Family Court (when Family Court is not in session) matters. The Town Court also handles Local Zoning, Land-Use and State Health and Fire Code violations as well as Dog Ordinance, Environmental Conservation, Navigation Law, Tax and Transportation Law violations that occur within the Town of Otsego.

Town Justice Courts are frequently called "the Courts closest to the People" because of their broad, although limited, jurisdiction over matters that affect the local community. Our mission is to serve our community by providing "justice" - timely, fair and equal justice - and to fulfill our Constitutional mandates as a "separate but equal" branch of government.

Justice Gary M. Kuch and Justice Jesse Torruella preside over the Otsego Town Court.

The Court is located at the back of the Town Office Building, at 811 Co Hwy 26 in the hamlet of Fly Creek. The Court's mailing address is P.O. Box 57, Fly Creek, NY 13337-0057.

VTL (Traffic Court) cases will be heard every Wednesday evening at 6:30pm with the exception of the 3rd Wednesday of the month. This date is reserved for the ADA Court where criminal cases will be heard at 3:30pm.

Payment Information:
By State law, only CASH or CERTIFIED funds are accepted, and only in US dollars. Certified checks and Postal Money Orders are to be made payable to the Town of Otsego Court. Payments may be made in person or through the mail. Personal checks are not accepted.

Directions to the Court:
From the north:
Traveling south on State Highway 28, turn right at the blinking light at the 4-corners in Fly Creek, bear to the left (the Firehall will be on your left) and go straight on Co Hwy 26 approximately 1,000 yards. The Town Offices will be on your right. Entrance to the Town Court is at the rear of the Town Building.

From the south:
Traveling north on State Highway 28, turn left on Co Hwy 26 (just past the Ford Dealership) and continue straight approximately 2.5 miles, the Town Offices will be on the left. (If you get to the Firehall, you have gone to far). Entrance to the Town Court is at the rear of the Town Building.

Traveling north on State Highway 205, turn right on State Highway 80, then turn right on State Highway 28 (south) and follow directions as if coming from the north.

From the west:
Traveling on State Highway 80, turn right on State Highway 28 (south) and follow directions as if coming from the north.

From Cooperstown:
Traveling south on Chestnut Street from the traffic light, turn right at the Methodist Church (State Highway 28 north and State Highway 80 west), go straight to the 4-corners in Fly Creek, turn left onto Co Hwy 26, go straight on Co Hwy 26 approximately 1,000 yards, The Town Offices will be on your right.
